Legislation Overview
Title: MICROSTAMPING-ENABLED PISTOL
Description: Creates the Microstamping-Enabled Pistols Act. Provides that the Director of the Illinois State Police or the Director's designee shall: (1) within 180 days after the effective date of the Act, engage in and complete an investigation to certify the technological viability of microstamping-enabled pistols. Provides that this investigation shall include live-fire testing evidence; and (2) within 180 days after the effective date of the Act, certify or decline to certify that microstamping-enabled pistols are technologically viable. Establishes procedures that the Illinois State Police must follow after a certification by the Illinois State Police that microstamping-enabled pistols are technologically viable. Provides that it is unlawful for any dealer in firearms licensed under the Firearm Dealer License Certification Act to sell, offer for sale, exchange, give, transfer or deliver any semiautomatic pistol unless such pistol has been verified as a microstamping-enabled pistol. Provides that a dealer who violates this provision is guilty of a Class 3 felony. Provides that the penalty provisions are operative either 4 years after certification that microstamping-enabled pistols are technologically viable by the Director of the Illinois State Police or the Director's designee, or one year after a person association, partnership, corporation, or other entity has been licensed to engage in the business of servicing firearms and their components to ensure compliance with the requirements of the Act, whichever is earlier. Effective immediately.
