Legislation Overview

Title: CRIM CD-UUW-FIREARMS-EXEMPT

Description: Amends the Criminal Code of 2012. Exempts from the offenses of unlawful use of weapons and aggravated unlawful use of a weapon concerning the possession and carrying of firearms, with written permission of the school board, a person certified as a teacher under the School Code and employed as a teacher by a school district, while actually engaged in the performance of the duties of his or her employment or commuting between his or her home and place of employment. Provides that the person must have successfully completed, at his or her own expense, a course of study, approved by and supervised by the Department of Financial and Professional Regulation, consisting of not less than 40 hours of training that includes theory of law enforcement, liability for acts, and the handling of weapons. Provides that a person shall be considered to be eligible for this exemption if he or she has completed the required 20 hours of training for a security officer and 20 hours of required firearm training, and has been issued a firearm control card by the Department of Financial and Professional Regulation. Provides that notwithstanding any other provisions of law, no school district may require any teacher, as a condition of employment, to carry a firearm as authorized under this provision.
