The head of the state's sheriff association is warning that a new gun permit that goes into effect Jan. 1 will not work as intended because of issues with the federal government.

Technically, residents can still apply for a 'gold card' permit, but because of issues at the federal level, the state can't begin fingerprinting applicants, according to Staci Ackerman, the executive director of the South Dakota Sheriffs' Association. And without fingerprints, the permit can’t be approved.

Additionally, Ackerman said in an email, the Bureau of Alcohol Tobacco and Firearms can't approve the permit until after the law goes into effect on Jan. 1.

The gold card is intended to allow holders to make gun purchases without having to go through the federal National Instant Criminal Background Check System, or NICS, for each purchase. Currently, each time a person buys a firearm they must submit to an NICS check.

But in return for the ease of buying firearms, applicants must pass an FBI fingerprint screening as well as standard background checks.
