Delaware HB125

Title: An Act To Amend Title 11 Of The Delaware Code Relating To Firearms.

Description: Section 1 of this bill establishes the crimes of possession of an unfinished firearm frame or receiver with no serial number, possession of and manufacturing a covert or undetectable firearm, possession of and manufacturing an untraceable firearm, and manufacturing or distributing a firearm using a three-dimensional printer. This bill also makes it a crime to possess a firearm frame or receiver with a removed, obliterated, or altered serial number. This bill makes very limited exceptions to the requirement that certain guns have serial numbers which are: (1) Firearms manufactured before 1968; (2) Muzzle loaders that only use black powder, and antique replicas. Finally, this bill makes clear that § 1463 of Title 11 concerning untraceable firearms does not apply to members of the military forces or members of a police force in this State duly authorized to carry an untraceable firearm, and does not apply to the manufacture or importation for sale to a law-enforcement or military entity in this State.

Description: This Act prohibits a person who is the subject of a Protection from Abuse Order of the Family Court and who knows or has reason to know, that the Order has been issued from purchasing, owning, possessing, or controlling a deadly weapon or ammunition for a firearm in this State. This Act also prohibits the subject of an outstanding arrest warrant, active indictment or information related to a felony or misdemeanor crime of domestic violence from purchasing a firearm. The subject of the pending criminal process must know or have reason to know that the process is pending in order for the prohibition to apply. This Act also makes technical changes to the existing law to make it conform to the Legislative Drafting Manual.

Description: Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health, subject to appropriation or other available funding, shall conduct a program to promote awareness of firearms restraining orders to the general public. Provides that beginning July 1, 2022, the program must include the development and dissemination, through print, digital, and broadcast media, of public service announcements that publicize the options victims of domestic violence have to seek help with special emphasis on the firearms restraining order. Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Creates the Commission on Implementing the Firearms Restraining Order Act. Amends the Illinois Police Training Act. Provides that the Illinois Law Enforcement Training Standards Board shall develop and approve a standard curriculum for a training program on the Firearms Restraining Order Act. Provides that the Board shall conduct a training program that trains officers on the use of firearms restraining orders, how to identify situations in which a firearms restraining order is appropriate, and how to safely promote the usage of the firearms restraining order in a domestic violence situation. Provides that the curriculum of police training schools shall also include training on the use of a firearms restraining order by providing instruction on the process used to file a firearms restraining order, how to identify situations in which a firearms restraining order is appropriate, and how to promote a firearms restraining order in a domestic violence situation. Provides that if adequate firearms restraining order training is unavailable, the Illinois Law Enforcement Training Standards Board may approve training to be conducted by a third party. Officers who have successfully completed this program shall be issued a certificate attesting to their attendance. Amends the Firearms Restraining Order Act. Provides that a firearms restraining order includes the seizure of the respondent's ammunition and firearm parts that could be assembled to make an operable firearm. Provides that "family member of the respondent" includes a former spouse and a person with whom the respondent has or allegedly has a child in common. Provides that a petition for a firearms restraining order may be filed in any county where an incident occurred that involved the respondent posing an immediate and present danger of causing personal injury to the respondent or another by having in his or her custody or control, or purchasing, possessing, or receiving, a firearm or ammunition or firearm parts that could be assembled to make an operable firearm. Includes printing a petition for a firearms restraining order for which no fees may be charged by the circuit clerk. Provides that the Illinois State Police shall submit a yearly report to the General Assembly concerning the applications and issuance of firearms restraining orders. Makes other changes.

Defines "state building" and removes affirmative defense for possession of firearm in state building by concealed handgun licensee. Provides that prohibition of firearms in public buildings does not apply to person who possesses unloaded firearm in airport in locked container for transportation in accordance with federal law. Punishes violation by maximum of five years' imprisonment, $125,000 fine, or both.] Requires person to secure firearm with trigger or cable lock, in locked container or in gun room except in specified circumstances. Punishes violation by maximum of $500 fine. Punishes violation by maximum of $2,000 fine if minor obtains unsecured firearm as result of violation. Provides that failure to secure firearm as required constitutes negligence per se. Specifies exceptions. Requires owner or possessor of firearm to secure firearm with trigger or cable lock or in locked container when transferring firearm under circumstances requiring criminal background check. Punishes violation by maximum of $500 fine. Provides that transfer of unsecured firearm constitutes negligence per se. Specifies exceptions. Requires person to report loss or theft of firearm within 72 hours of time person knew or reasonably should have known of loss or theft. Provides that failure to report lost or stolen firearm constitutes negligence per se. Punishes violation of requirement by maximum of $1,000 fine. Requires person transferring firearm to minor to directly supervise minor's use of firearm. Provides that failure to supervise minor constitutes negligence per se. Authorizes person to transfer supervisory duty to another person. Specifies exceptions. Authorizes board of public university, Oregon Health and Science University, community college or school district to adopt policy providing that affirmative defense for concealed handgun licensees possessing firearms on school grounds does not apply. Provides that in prosecution for possession of firearm on school grounds subject to policy, within Capitol, or within passenger terminal of certain airports, concealed handgun licensee affirmative defense is not complete defense but results in Class A misdemeanor conviction punishable by 364 days' imprisonment, $6,250 fine, or both. Modifies definition of "public building," for purposes of crime of possession of weapon in public building, to include passenger terminal of certain airports. Creates affirmative defense to crime for persons who possess unloaded firearm in passenger terminal in locked container for transportation in accordance with federal law. Increases fees payable to county sheriff for issuance and renewal of concealed handgun license. Takes effect on 91st day following adjournment sine die.

Description: Carrying a firearm or explosive material within Capitol Square and the surrounding area, into a building owned or leased by the Commonwealth, etc.; penalty. Makes it a Class 1 misdemeanor for a person to carry any firearm or explosive material within (i) the Capitol of Virginia; (ii) Capitol Square and the surrounding area; (iii) any building owned or leased by the Commonwealth or any agency thereof; or (iv) any office where employees of the Commonwealth or agency thereof are regularly present for the purpose of performing their official duties. The bill provides exceptions for the following individuals while acting in the conduct of such person's official duties: any law-enforcement officer, any authorized security personnel, any active military personnel, any fire marshal when such fire marshal has been granted police powers, or any member of a cadet corps while such member is participating in an official ceremonial event for the Commonwealth. The prohibitions of the bill that apply to any building owned or leased by the Commonwealth or any office where state employees are performing official duties do not apply to retired law-enforcement officials visiting a gun range owned or leased by the Commonwealth or any of the following while acting in the conduct of official duties: a bail bondsman, an employee of the Department of Corrections or a state juvenile correctional facility, an employee of the Department of Conservation and Recreation, or an employee of the Department of Wildlife Resources. Such prohibitions also do not apply to an individual carrying a weapon into a courthouse who is statutorily exempt, any property owned or operated by a public institution of higher education, any state park, or any magistrate acting in the conduct of the magistrate's official duties. The bill requires that notice of the provisions prohibiting the carrying of such firearms or explosive material be posted at each of the public entrances to Capitol Square and the other locations where such firearms and explosive material are prohibited in the bill. The bill provides that any firearm or explosive material carried in violation of these provisions is subject to seizure by a law-enforcement officer and forfeiture to the Commonwealth.
