Title: Neighborhood Engagement Achieves Results Act Of 2015

Description: Sequentially referred as follows: Title 2; Committee on Health and Human Services for 60 days then the entire bill to Committee on Judiciary. Law 21-125 establishes the Office of Neighborhood Safety and Engagement (ONSE) to engage individuals with a high risk of participating in, or being a victim of, violent criminal activity. It establishes an Office of Violence Prevention and Health Equity within the Department of Health, and establishes within the Metropolitan Police Department, a Community Crime Prevention Team Program to reduce crime and increase access to social services. It requires the ONSE to conduct data collection and analysis on outcomes and report them annually to the Council. It places social workers in MPD and requires MPD to include training on preventing biased-based policing, and the unlawful use of force. MPD is also required to collect stop and frisk data, use of force data, data regarding citizens complaints as well as in custody deaths. It expands certain personnel authority of the Chief of Police. It expands the rights of pretrial defendants and of misdemeanant inmates with regard to work, education release and good behavior. It also among other things extends the date for implementation of the microstamping requirement for semiautomatic pistols to January 1, 2018. This legislation is Subject to Appropriations. Title: An Act To Amend Title 11 Of The Delaware Code Relating To Law Enforcement Procedure With Respect To Firearms And Firearm Related Evidence.

Description: One of the findings of the Wilmington Public Safety Strategies Commission was that the Wilmington Police Department should enhance its use of firearms investigative and intelligence tools and ballistics technology in investigating and preventing violent crime. The report went on to recommend adoption of a protocol such as the one employed by New Jersey statute in 2013 to mandate statewide the use of certain nationwide firearm and ballistics databases. This bill is modeled on the New Jersey statute. It mandates the entry of ballistics information into the National Integrated Ballistics Identification Network, and firearm information into the ATF E-Trace system and the National Crime Information Center System. This bill further directs the Department of Safety and Homeland Security, in cooperation with the Department of Justice, to develop a statewide standard protocol for the recovery and processing of firearms and firearm related evidence.

Provides that firearms trafficking by a person who has been previously convicted of firearms trafficking, gunrunning, or a felony offense for the unlawful sale, delivery, or transfer of a firearm or firearm ammunition in this State or another jurisdiction is a Class X felony. Amends the Unified Code of Corrections. Provides that a period of probation, a term of periodic imprisonment or conditional discharge shall not be imposed when the person has been found guilty of firearms trafficking involving both a firearm and firearm ammunition. Provides that the court shall sentence the offender to not less than the minimum term of imprisonment for the offense. Effective immediately.

Description: Amends the Firearm Owners Identification Card Act. Provides that upon adjudication of any individual as a person with a mental disability or a finding that a person has been involuntarily admitted, the circuit court clerk shall (rather than the court shall direct the circuit court clerk to) immediately notify the Department of State Police, Firearm Owner's Identification (FOID) department. Provides that beginning July 1, 2016, and each July 1 and December 30 of every year thereafter, the court shall direct the circuit court clerk to notify the Department of State Police, Firearm Owner's Identification (FOID) department if the court has not adjudicated any individual as a person with a mentally disability within the preceding 6 months. Current law recognizes concealed handgun permits issued by states that (a) provide a 24-hour-a-day means of verification of the validity of the permits issued in that state and (b) have requirements and qualifications that are adequate to prevent possession of a permit by persons who would be denied a permit in Virginia. In addition, the bill requires the Superintendent, within 60 days of the effective date of the bill, to enter into agreements for reciprocal recognition of concealed handgun permits or licenses with other states where agreements were in existence on December 1, 2015.

Title: Relating to carry or use of a handgun or deadly weapon

Description: The purpose of this bill is to authorize residents of the State of West Virginia to carry a firearm in a concealed manner, without permit, so long as certain conditions are met. The bill permits eligible persons to carry a handgun for self-defense purposes, without permit, while afield. It establishes that criminal penalties for carrying a concealed deadly weapon without state license or other lawful authorization apply only to persons under twenty-one years of age. The bill requires an applicant for a concealed weapon permit to be a United States citizen or legal resident thereof and a resident of this state and of the county in which application is made. The bill permits persons eighteen years and older to obtain a concealed carry permit. It requires actual live firing of ammunition in training and requires an applicant for a concealed carry permit to provide a copy of the instructor’s certification. The bill requires that on or after January 1, 2017, all duplicate license cards issued by county sheriffs to be uniform across all fifty-five counties and feature a photograph of the licensee. It requires State Police, in cooperation with the Sheriffs’ Bureau of Professional Standards, to prepare uniform applications for licenses and license cards. The bill creates a provisional license to carry concealed deadly weapons for persons between eighteen and twenty-one years of age and establishes provisional license application requirements and procedures. The bill exempts members of the United States Armed Forces, Reserve or National Guard from permit requirements and eliminates the requirement for persons twenty-one years of age and older to possess a permit to carry a concealed deadly weapon provided that certain conditions are met, including being a United States citizen or legal resident, being twenty-one years of age or older and not prohibited from possessing firearms. The bill requires a school principal to report certain violations to the State Police, provides enhanced penalties for use of a firearm during commission of a felony. And, provides for an exception to enhanced penalties in certain circumstances when a firearm is used in defense of self or others.
