A BILL TO BE ENTITLED

AN ACT to create the criminal offense of discharging a firearm with reckless disregard.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 36 of Chapter 14 of the General Statutes is amended by adding a new section to read:

"§ 14-280.3.  Discharge a firearm with reckless disregard.

Unless the conduct is covered under another provision of law that provides greater punishment, any person deliberately bent on mischief who discharges a firearm in such a reckless and wanton manner as to manifest a mind utterly without regard for human life and social duty and as a result causes serious injury to another person is guilty of a Class F felony. If a person commits an offense under this section and causes serious bodily injury, the person is guilty of a Class D felony."

SECTION 2.  This act becomes effective December 1, 2013, and applies to offenses committed on or after that date.
