A BILL TO BE ENTITLED
AN ACT to EXEMPT A CERTAIN INTERLOCAL AGREEMENT BETWEEN THE CITY OF ASHEVILLE AND HENDERSON COUNTY CONCERNING THE BENT CREEK PROPERTY FROM ARTICLE 16 OF CHAPTER 160A OF THE GENERAL STATUTES AND FROM THE SULLIVAN ACTS.
The General Assembly of North Carolina enacts:
SECTION 1. As to an interlocal agreement entered into between those two parties on April 16, 2014, the City of Asheville and the County of Henderson are relieved from compliance with (i) Chapter 399 of the 1933 Public‑Local Laws (known as the "Sullivan Act"), (ii) Article 16 of Chapter 160A of the General Statutes, as amended by S.L. 2005‑139 (known as "Sullivan Act II"), (iii) S.L. 2005‑140 (known as "Sullivan Act III"), and (iv) S.L. 2009‑114 (amendment to the Sullivan Act) with regard to the use of the Bent Creek Property and the disposition of proceeds from the sale of said property as provided for in the April 16, 2014 Interlocal Agreement.
SECTION 2. This act is effective when it becomes law.
