       AN ACT to amend the administrative code of the  city  of  New  York,  in
         relation to promotions of captains
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision c of section 14-114 of the administrative  code
    2  of the city of New York is amended to read as follows:
    3    c.  The  commissioner shall, in the exercise of his or her discretion,
    4  from time to time, detail nineteen captains and so many  others  as  the
    5  mayor  may  authorize upon the recommendation of the commissioner to act
    6  as inspectors, with the title, while so acting, of inspectors of  police
    7  and  at his or her pleasure may revoke any or all such details. While so
    8  detailed, such officers shall receive a salary to be fixed by the mayor,
    9  in addition to the amount of salary  which  regularly  attaches  to  the
   10  office of captain.  When a captain shall have acted under regular detail
   11  in  any  capacity  above the rank of captain, during a period or periods
   12  aggregating two years, such officer, upon  becoming  eligible  therefor,
   13  shall  be  entitled to a pension of not less than one-half of the salary
   14  received by him or her per year. When the commissioner, however,  desig-
   15  nates a captain to act in the place of a captain under regular detail as
   16  inspector,  during the temporary absence or disability of the latter the
   17  officer so designated shall not be entitled to  any  additional  salary,
   18  and  the  period  of such designation shall not be counted in his or her
   19  favor in computing such two-year period.   When  a  CAPTAIN  SHALL  HAVE
   20  SERVED  IN  THE RANK OF CAPTAIN FOR A PERIOD OF FIFTEEN YEARS, HE OR SHE
   21  SHALL HAVE THE SAME RIGHTS IN RESPECT TO THE POLICE PENSION  FUND  AS  A
   22  CAPTAIN  DETAILED  TO  ACT AS DEPUTY CHIEF WHO SHALL HAVE SERVED AS SUCH
   23  FOR A PERIOD OF TIME AGGREGATING TWO YEARS.   A captain WHO  shall  have
   24  served  [in  the  rank  of  captain  for  a period of] AS SUCH LESS THAN

    1  FIFTEEN YEARS AND MORE THAN ten years[, he or she] shall have  the  same
    2  rights  in  respect  to the police pension fund as a captain detailed to
    3  act as inspector who shall have served as such  for  a  period  of  time
    4  aggregating two years. A captain who shall have served as such less than
    5  ten years and more than five years shall have the same rights in respect
    6  to  such  police  pension  fund as a captain detailed to act as a deputy
    7  inspector who shall have served as such for a period of time aggregating
    8  two years. A period beginning March thirtieth, nineteen  hundred  sixty-
    9  five,  and ending November thirtieth, nineteen hundred sixty-six, during
   10  which a captain shall have served as a provisional  captain  immediately
   11  prior to a permanent promotion to such rank shall be deemed to have been
   12  service  as  a  permanent  captain  for  the purposes of this section. A
   13  captain, while detailed to act as inspector, shall  be  chargeable  with
   14  and responsible for the discipline and efficiency of the force under his
   15  or her command.
   16    S 2. This act shall take effect immediately.
