CROUCH -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to big game hunting in the counties of Broome, Chenango and Tioga THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The opening paragraph of paragraph a of subdivision 2 of 2 section 11-0907 of the environmental conservation law, as amended by 3 chapter 600 of the laws of 1993, is amended to read as follows: 4 Regular open hunting seasons for [deer] BIG GAME are established sepa- 5 rately for the named regions or parts of regions, or named counties 6 listed in column one of the table set forth in this subdivision, and are 7 specified as seasons for taking by pistol, rifle, shotgun, or long bow, 8 or for taking by shotgun or long bow only, or for taking by long bow 9 only, as indicated in column three entitled "Manner of Taking". Where 10 taking of big game by shotgun is permitted by this chapter such shotgun 11 may contain rifling in all or a portion of the barrel, provided, howev- 12 er, if the barrel or a portion thereof does contain rifling only shells 13 having non-metallic cases, except for the base, may be used. In the 14 areas identified in column one except in the "closed areas" specified in 15 subdivision 5 the game specified in column two may be taken in the open 16 season stated in column two immediately following the specification of 17 the game, in the manner specified in column three. 18 S 2. Items (f) and (i) of paragraph a of subdivision 2 of section 19 11-0907 of the environmental conservation law, item (f) as amended by 20 chapter 323 of the laws of 2011 and item (i) as amended by chapter 231 21 of the laws of 2012, are amended and a new item (k) is added to read as 22 follows: 23 (f) Southern tier, Deer, first Monday Pistol, shotgun, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. Item (i) of paragraph a of subdivision 2 of section 11-0907 of 6 the environmental conservation law, as amended by section 2 of chapter 7 600 of the laws of 2005, is amended to read as follows: 8 (i) The counties of Deer and bear, the Pistol, shotgun, 9 Allegany, BROOME, first Monday after muzzle loading 10 Cattaraugus, November 15 through firearm, rifle or 11 Chenango, Herkimer, first Tuesday after long bow only 12 Montgomery, Oneida, December 7 13 Oswego, Otsego, 14 Schoharie and Tioga 15 [and that portion 16 of the county 17 of Broome east of the 18 Susquehanna river] 19 S 5. This act shall take effect immediately, provided that the amend- 20 ments to the opening paragraph of paragraph a of subdivision 2 of 21 section 11-0907 of the environmental conservation law made by section 22 one of this act shall be subject to the expiration and reversion of such 23 paragraph pursuant to chapter 600 of the laws of 1993 and shall be 24 deemed to expire therewith; the amendments to item (f) of paragraph a of 25 subdivision 2 of section 11-0907 of the environmental conservation law 26 made by section two of this act shall be subject to the expiration and 27 reversion of such item pursuant to chapter 323 of the laws of 2011, as 28 amended, and to item (i) of paragraph a of subdivision 2 of section 29 11-0907 of the environmental conservation law made by section two of 30 this act shall be subject to the expiration and reversion of such item 31 pursuant to chapters 321 and 326 of the laws of 2011, when upon such 32 date the provisions of section three of this act shall take effect; 33 provided further, that the amendments to items (f) and (i) of paragraph 34 a of subdivision 2 of section 11-0907 of the environmental conservation 35 law made by section three of this act and item (k) of such paragraph as 36 added by section two of this act, shall be subject to the expiration and 37 reversion of such paragraph pursuant to section 13 of chapter 600 of the 38 laws of 1993, as amended, when upon such date the provisions of section 39 four of this act shall take effect.
