Section 5-a of the legislative law, as added by chapter 630 2 of the laws of 1998, that portion of subdivision 1 entitled "SENATE 3 OFFICERS", as amended by chapter 631 of the laws of 1998, that portion 4 of subdivision 1 entitled "SENATORS SERVING IN SPECIAL CAPACITY", as 5 amended by section 2 and that portion of subdivision 1 entitled "ASSEM- 6 BLYMEN SERVING IN SPECIAL CAPACITY", as amended by section 3 of part XX 7 of chapter 56 of the laws of 2009, paragraphs c and d of subdivision 2 8 as added by chapter 635 of the laws of 1998 and the opening paragraph of 9 subdivision 3 as amended by section 1 of part K of chapter 55 of the 10 laws of 2014, is amended to read as follows: 11 S 5-a. review 4 commission .................................................... 12,500] 5 THE TEMPORARY PRESIDENT OF THE SENATE OR THE SPEAKER OF THE ASSEMBLY 6 SHALL BE PAID AN ALLOWANCE OF FORTY-ONE THOUSAND FIVE HUNDRED DOLLARS. 7 THE TEMPORARY PRESIDENT OF THE SENATE SHALL ALSO RECEIVE AN ALLOWANCE OF 8 ONE HUNDRED TWENTY-SEVEN THOUSAND DOLLARS TO BE DIVIDED AND DISTRIBUTED 9 TO FOUR MEMBERS OF THE SENATE SERVING AS AN OFFICER AS DIRECTED BY THE 10 TEMPORARY PRESIDENT OF THE SENATE. THE SPEAKER OF THE ASSEMBLY SHALL 11 ALSO RECEIVE AN ALLOWANCE OF ONE HUNDRED TEN THOUSAND DOLLARS TO BE 12 DIVIDED AND DISTRIBUTED TO FOUR MEMBERS OF THE ASSEMBLY SERVING AS AN 13 OFFICER AS DIRECTED BY THE SPEAKER OF THE ASSEMBLY. THE MINORITY LEADER 14 OF THE SENATE SHALL RECEIVE AN ALLOWANCE OF NINETY-TWO THOUSAND DOLLARS 15 TO BE DIVIDED AND DISTRIBUTED TO FOUR MEMBERS OF THE SENATE AS DIRECTED 16 BY THE MINORITY LEADER OF THE SENATE. THE MINORITY LEADER OF THE ASSEM- 17 BLY SHALL RECEIVE AN ALLOWANCE OF NINETY-ONE THOUSAND DOLLARS TO BE 18 DIVIDED AND DISTRIBUTED AS DIRECTED BY THE MINORITY LEADER OF THE ASSEM- 19 BLY. 20 2. a. No member of the legislature may, at the same time, receive 21 payment of more than one allowance provided for in this section. 22 b. The allowances set forth in this section shall be paid at such time 23 or times as the temporary president of the senate or speaker of the 24 assembly shall direct for their respective houses. 25 c. If legislative passage of the budget as defined in subdivision 26 three of section five of this article has not occurred prior to the 27 first day of any fiscal year, the net amount of any allowances author- 28 ized pursuant to this section to be paid on or after such date shall be 29 withheld and not paid until such legislative passage of the budget has 30 occurred whereupon the payment of such allowances in an amount equal to 31 the withheld and unpaid payments shall be paid pursuant to paragraph b 32 of this subdivision. 33 For purposes of this section, net amount shall mean gross salary minus 34 any or all of the following deductions: federal taxes, state taxes, 35 social security taxes, city taxes, payments on retirement loans, retire- 36 ment contributions, contributions to health insurance or other group 37 insurance programs, child support and court ordered payments. 38 d. No payment of an allowance to a member of the legislature pursuant 39 to this section shall exceed one-fourth of such authorized allowance 40 during the period of January first through March thirty-first in any 41 year. 42 [3. The commission may employ and at pleasure remove such personnel as 15 it may deem necessary for the performance of the commission's functions 16 and fix their compensation within the amount appropriated therefor. The 17 commission may hold public and private hearings and otherwise have all 18 of the powers of a legislative committee under this chapter. The members 19 of the commission shall receive no compensation for their services[, 20 except as provided pursuant to section five-a of this chapter,] but 21 shall be allowed their actual and necessary expenses incurred in the 22 performance of their duties hereunder. 23 S 3. Subdivision 7 of section 83-e of the legislative law, as added 24 by chapter 141 of the laws of 1994, is amended to read as follows: 25 7. The commission may employ and at pleasure remove such personnel as 26 it may deem necessary for the performance of the commission's functions 27 and fix compensation within the amount appropriated therefor. The 28 commission may hold public and private hearings and otherwise have all 29 of the powers of a legislative committee under this chapter. The members 30 of the commission and advisory board shall receive no compensation for 31 their services[, except as provided pursuant to section five-a of this 32 chapter,] but shall be allowed their actual and necessary expenses 33 incurred in the performance of their duties hereunder. 34 S 4. Subdivision 4 of section 83-f of the legislative law, as added by 35 chapter 141 of the laws of 1994, is amended to read as follows: 36 4. The commission may employ and at pleasure remove such personnel as 37 it may deem necessary for the performance of the commission's functions 38 and fix their compensation within the amount appropriated therefor. The 39 commission may hold public and private hearings and otherwise have all 40 of the powers of a legislative committee under this chapter. The members 41 of the commission shall receive no compensation for their services[, 42 except as provided pursuant to section five-a of this chapter,] but 43 shall be allowed their actual and necessary expenses incurred in the 44 performance of their duties hereunder. 45 S 5. A. 4626 9 1 S 6. Subdivision 4 of section 83-l of the legislative law, as amended 2 by chapter 83 of the laws of 1995, is amended to read as follows: 3 4. The commission may employ and at pleasure remove such personnel as 4 it may deem necessary for the performance of the commission's functions 5 and fix their compensation within the amount appropriated therefor. The 6 commission may hold public and private hearings and otherwise have all 7 of the powers of a legislative committee under this chapter. The members 8 of the commission shall receive no compensation for their services[, 9 except as provided pursuant to section five-a of this chapter,] but 10 shall be allowed their actual and necessary expenses incurred in the 11 performance of their duties hereunder. 12 S 7. This act shall take effect immediately; provided, however, that: 13 (a) the amendments to subdivision 3 of section 83-c of the legislative 14 law made by section two of this act; 15 (b) the amendments to subdivision 7 of section 83-e of the legislative 16 law made by section three of this act; 17 (c) the amendments to subdivision 4 of section 83-f of the legislative 18 law made by section four of this act; 19 (d) the amendments to subdivision 4 of section 83-i of the legislative 20 law made by section five of this act; and 21 (e) the amendments to subdivision 4 of section 83-l of the legislative 22 law made by section six of this act; 23 shall not affect the repeal of article 5-A of the legislative law and 24 shall be deemed repealed therewith.
