        AN  ACT  to  amend the general business law, in relation to age require-
          ments for gun shows

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Paragraphs (b) and (c) of subdivision 1 of section 896 of
     2  the general business law, paragraph (b) as added by chapter 189  of  the
     3  laws  of 2000 and paragraph (c) as amended by chapter 371 of the laws of
     4  2022, are amended and a new paragraph (d) is added to read as follows:
     5    (b) notify all firearm exhibitors in writing that a  national  instant
     6  criminal  background  check must be completed prior to all firearm sales
     7  or transfers, including sales or transfers of rifles or shotguns; [and]
     8    (c) coordinate with the division of state police to provide access  at
     9  the  gun  show  to  perform a national instant criminal background check
    10  prior to any firearm sale or transfer. Any firearm dealer licensed under
    11  federal law who submits a request to the division  of  state  police  to
    12  perform  a  national  instant criminal background check pursuant to this
    13  paragraph shall provide the seller or transferor of the  firearm,  rifle
    14  or  shotgun  with  a  copy  of the United States Department of Treasury,
    15  Bureau of Alcohol, Tobacco and Firearms and Explosives Form ATF  F  4473
    16  and  such  dealer  shall maintain such form and make such form available
    17  for inspection by law enforcement agencies for a  period  of  ten  years
    18  thereafter[.]; and
    19    (d)  prohibit  entrance to the gun show of any person who is under the
    20  age of twelve years of age.
    21    § 2. This act shall take effect immediately; provided,  however,  that
    22  paragraph  (c)  of  subdivision 1 of section 896 of the general business
    23  law, as amended by section one of this act shall take effect on the same
    24  date and in the same manner as chapter 371 of the laws  of  2022,  takes
    25  effect.
