        AN ACT to amend the penal law, in relation to the unlawful wearing of  a
          body vest
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subdivision 1 of  section  270.20  of  the  penal  law,  as
     2  amended  by  chapter  317  of  the  laws  of 2001, is amended to read as
     3  follows:
     4    1. A person is guilty of the unlawful wearing  of  a  body  vest  when
     5  acting  either alone or with one or more other persons he or she wears a
     6  body vest and:
     7    (a) commits any violent felony offense defined in  section  70.02,  or
     8  any class A felony offense other than one defined in article two hundred
     9  twenty,  or  commits  assault or reckless endangerment as those offenses
    10  are defined in article one hundred twenty, while possessing or appearing
    11  to possess a firearm, rifle [or], shotgun [and in the course of  and  in
    12  furtherance  of such crime he wears a body vest], deadly weapon, danger-
    13  ous instrument or ammunition; or
    14    (b) commits any violent felony offense as defined in section 70.02  or
    15  any class A felony offense other than one defined in article two hundred
    16  twenty,  having previously been convicted within the preceding ten years
    17  of any such offense.
    18    § 2. This act shall take effect on the sixtieth  day  after  it  shall
    19  have become a law.
