AN ACT TO AMEND SECTION 19-7-5, MISSISSIPPI CODE OF 1972, TO ALLOW THE BOARD OF SUPERVISORS OF A COUNTY TO ALLOW THE USE OR TRANSFER OF COUNTY ROAD EQUIPMENT TO OTHER DEPARTMENTS OF THE COUNTY WITHOUT REIMBURSEMENT TO ROAD AND BRIDGE FUNDS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 19-7-5, Mississippi Code of 1972, is amended as follows:

     19-7-5.  (1)  The board of supervisors shall have the power to sell and dispose of any personal property and real property belonging to the county or any subdivision thereof according to the uniform personal property and real property disposal requirements for local governments in Section 17-25-25.  For purposes of this section, the term "personal property," includes, but is not limited to, equipment, vehicles, fixtures, furniture, firearms and commodities.

     (2)  The board of supervisors may allow the use and services and equipment of the county road department by other departments of the county and may transfer county road equipment to other departments of the county without reimbursement to the road and county bridge funds under Sections 65-15-3 and 65-15-7 without meeting the requirements of Sections 17-25-25 and 31-7-13, upon the unanimous approval of an order duly adopted by the board and entered on it's minutes.

     (3)  Nothing contained in this section shall be construed to prohibit, restrict or to prescribe conditions with regard to the  authority granted under Section 17-25-3.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2014.
