1.20APPROPRIATIONS

 Section 1. CAPITAL IMPROVEMENT APPROPRIATIONS.
1.22    The sums shown in the column under "Appropriations" are appropriated from the
1.23bond proceeds fund, or another named fund, to the state agencies or officials indicated,
1.24to be spent for public purposes. Appropriations of bond proceeds must be spent as
1.25authorized by the Minnesota Constitution, article XI, section 5, paragraph (a), to acquire
1.26and better public land and buildings and other public improvements of a capital nature, or
1.27as authorized by the Minnesota Constitution, article XI, section 5, paragraphs (b) to (j),
1.28or article XIV. Unless otherwise specified, money appropriated in this act for a capital

 Subd. 18.Debt Service
7.22(a) Except as provided in paragraph (b), the
7.23Board of Trustees shall pay the debt service
7.24on one-third of the principal amount of state
7.25bonds sold to finance projects authorized
7.26by this section. After each sale of general
7.27obligation bonds, the commissioner of
7.28management and budget shall notify the
7.29board of the amounts assessed for each year
7.30for the life of the bonds.
7.31(b) The board need not pay debt service
7.32on bonds sold to finance HEAPR. Where a
7.33nonstate match is required, the debt service is
7.34due on a principal amount equal to one-third
8.1of the total project cost, less the match
8.2committed before the bonds are sold.
8.3(c) The commissioner of management and
8.4budget shall reduce the board's assessment
8.5each year by one-third of the net income
8.6from investment of general obligation bond
8.7proceeds in proportion to the amount of
8.8principal and interest otherwise required to
8.9be paid by the board. The board shall pay its
8.10resulting net assessment to the commissioner
8.11of management and budget by December
8.121 each year. If the board fails to make
8.13a payment when due, the commissioner
8.14of management and budget shall reduce
8.15allotments for appropriations from the
8.16general fund otherwise available to the board
8.17and apply the amount of the reduction to
8.18cover the missed debt service payment. The
8.19commissioner of management and budget
8.20shall credit the payments received from the
8.21board to the bond debt service account in
8.22the state bond fund each December 1 before
8.23money is transferred from the general fund
8.24under Minnesota Statutes, section 16A.641,
8.25subdivision 10.

 Subd. 19.Unspent Appropriations
8.27(a) Upon substantial completion of a project
8.28authorized in this section and after written

12.18section 84.946, the commissioner may use
12.19this appropriation to replace buildings if,
12.20considering the embedded energy in the
12.21building, that is the most energy-efficient and
12.22carbon-reducing method of renovation.

 Subd. 3.Flood Hazard Mitigation

12.24(a) For the state share of flood hazard
12.25mitigation grants for publicly owned capital
12.26improvements to prevent or alleviate flood
12.27damage under Minnesota Statutes, section

12.29(b) Levee projects, to the extent practical,
12.30shall meet the state standard of three feet
12.31above the 100-year flood elevation.
12.32(c) Project priorities shall be determined by
12.33the commissioner as appropriate and based
12.34on need, and to the extent possible, address

13.2first.

13.14(e) This appropriation includes money for the
13.15following watershed projects: Cedar River
13.16Watershed District; North Ottawa, Bois
13.17de Sioux Watershed District; Quick, Two
13.18Rivers Watershed District; Redpath, Bois de
13.19Sioux Watershed District; Roseau Wildlife
13.20Management Area, Roseau River Watershed
13.21District; and Shell Rock Watershed District.

13.24ready to proceed or does not expend all the

13.30income in a municipality or township
13.31multiplied by the number of households in the
13.32municipality or township, this appropriation

53.26the Minnesota Constitution, article XI, sections 4 to 7. The proceeds of the bonds, except
53.27accrued interest and any premium received on the sale of the bonds, must be credited to
53.28a bond proceeds account in the state transportation fund.
53.29    Subd. 3. Maximum effort school loan fund. To provide the money appropriated in
53.30this act from the maximum effort school loan fund, the commissioner of management and
53.31budget shall sell and issue bonds of the state in an amount up to $5,491,000 in the manner,
53.32upon the terms, and with the effect prescribed by Minnesota Statutes, sections 16A.631 to
53.3316A.675, and by the Minnesota Constitution, article XI, sections 4 to 7. The proceeds of
54.1the bonds, except accrued interest and any premium received on the sale of the bonds,

59.31    Sec. 28. Laws 2013, chapter 136, section 7, is amended to read:
59.32    Sec. 7. BOND SALE SCHEDULE.
59.33The commissioner of management and budget shall schedule the sale of state
59.34general obligation bonds so that, during the biennium ending June 30, 2015, no more
59.35than $1,280,165,000 $1,253,992,000 will need to be transferred from the general fund to
60.1the state bond fund to pay principal and interest due and to become due on outstanding
60.2state general obligation bonds. During the biennium, before each sale of state general
60.3obligation bonds, the commissioner of management and budget shall calculate the amount
60.4of debt service payments needed on bonds previously issued and shall estimate the amount
60.5of debt service payments that will be needed on the bonds scheduled to be sold. The
60.6commissioner shall adjust the amount of bonds scheduled to be sold so as to remain within
60.7the limit set by this section. The amount needed to make the debt service payments is
60.8appropriated from the general fund as provided in Minnesota Statutes, section 16A.641.

60.9    Sec. 29. APPROPRIATIONS GIVEN EFFECT ONCE.
60.10    Except for appropriations for the Flood Hazard Mitigation program, the Minnesota
60.11Children's Museum, the Lewis and Clark Regional Water System, the local bridge
60.12replacement program under Minnesota Statutes, section 174.50, to the local road
60.13improvement fund grants under Minnesota Statutes, section 174.52, and for highway-rail
60.14crossing warning devices, if an appropriation in this act is enacted more than once in the
60.152014 legislative session for the same purpose, the appropriation must be given effect only
60.16once. If the appropriations for the same purpose are for different amounts, the lowest of
60.17the amounts is the one to be given effect.

60.18    Sec. 30. EFFECTIVE DATE.
60.19    This article is effective the day following final enactment.

60.262018, the commissioner may sell bonds, including refunding bonds, at negotiated sale.

60.27    Sec. 2. Minnesota Statutes 2012, section 16A.642, subdivision 1, is amended to read:
60.28    Subdivision 1. Reports. (a) The commissioner of management and budget shall
60.29report to the chairs of the senate Committee on Finance and the house of representatives
60.30Committees on Ways and Means and Capital Investment by January 1 of each
60.31odd-numbered year on the following:
61.1(1) all laws authorizing the issuance of state bonds, bonds supported by a state
61.2appropriation, or appropriating general fund money for state or local government
61.3capital investment projects enacted more than four years before January 1 of that
61.4odd-numbered year; the projects authorized to be acquired and constructed for which
61.5less than 100 percent of the authorized total cost has been expended, encumbered, or
61.6otherwise obligated; the cost of contracts to be let in accordance with existing plans and
61.7specifications shall be considered expended for this report; and the amount of general fund
61.8money appropriated but not spent or otherwise obligated, and the amount of bonds not
61.9issued and bond proceeds held but not previously expended, encumbered, or otherwise
61.10obligated for these projects; and
61.11(2) all laws authorizing the issuance of state bonds, bonds supported by a state
61.12appropriation, or appropriating general fund money for state or local government capital
61.13programs or projects other than those described in clause (1), enacted more than four years
61.14before January 1 of that odd-numbered year; and the amount of general fund money
61.15appropriated but not spent or otherwise obligated, and the amount of bonds not issued
61.16and bond proceeds held but not previously expended, encumbered, or otherwise obligated
61.17for these programs and projects.
61.18(b) The commissioner shall also report on general fund appropriations for capital
61.19projects, bond authorizations or bond proceed balances that may be canceled because
61.20projects have been canceled, completed, or otherwise concluded, or because the purposes
61.21for which the money was appropriated or bonds were authorized or issued have been
61.22canceled, completed, or otherwise concluded. The general fund appropriations, bond
61.23authorizations or bond proceed balances that are unencumbered or otherwise not obligated
61.24that are reported by the commissioner under this subdivision are canceled, effective July 1
61.25of the year of the report, unless specifically reauthorized by act of the legislature.
61.26(c) The reports required by this subdivision shall only contain bond authorizations
61.27supported by a state appropriation and their associated general fund appropriations for
61.28projects authorized or amended after December 31, 2013.

61.29    Sec. 3. Minnesota Statutes 2012, section 16A.642, subdivision 2, is amended to read:
61.30    Subd. 2. Cancellation. (a) If the commissioner determines that the purposes for
61.31which general obligation bonds of the state or bonds supported by a state appropriation
61.32 have been issued or for which general fund monies were appropriated are accomplished
61.33or abandoned, after consultation with the affected agencies, and there is a remaining
61.34authorization or appropriation for a specific project of $500 or less, the commissioner may
61.35cancel the remaining authorization or appropriation for that project. Bonds supported by
62.1a state appropriation shall only be canceled if they were authorized or amended after
62.2December 31, 2013.
62.3(b) If a premium received on the sale of bonds is credited to the bond proceeds
62.4fund, pursuant to section 16A.641, subdivision 7, paragraph (b), the corresponding bond
62.5authorization to which the premium is attributable must be reduced accordingly by the
62.6commissioner.
62.7(c) The commissioner must notify the chairs of the senate Finance Committee and
62.8the house of representatives Capital Investment Committee of any bond authorizations,
62.9including bond authorizations supported by a state appropriation, or general fund
62.10appropriations canceled under this subdivision.

62.11    Sec. 4. Minnesota Statutes 2012, section 16B.335, subdivision 1, is amended to read:
62.12    Subdivision 1. Construction and major remodeling. (a) The commissioner, or
62.13any other recipient to whom an appropriation is made to acquire or better public lands or
62.14buildings or other public improvements of a capital nature, must not prepare final plans and
62.15specifications for any construction, major remodeling, or land acquisition in anticipation of
62.16which the appropriation was made until the agency that will use the project has presented
62.17the program plan and cost estimates for all elements necessary to complete the project to the
62.18chair of the senate Finance Committee and the chair of the house of representatives Ways
62.19and Means Committee and the chairs have made their recommendations, and the chair and
62.20ranking minority member of the senate Capital Investment Committee and the chair and
62.21ranking minority member of the house of representatives Capital Investment Committee is
62.22 are notified. "Construction or major remodeling" means construction of a new building,
62.23a substantial addition to an existing building, or a substantial change to the interior
62.24configuration of an existing building. The presentation must note any significant changes in
62.25the work that will be done, or in its cost, since the appropriation for the project was enacted
62.26or from the predesign submittal. The program plans and estimates must be presented for
62.27review at least two weeks before a recommendation is needed. The recommendations are
62.28advisory only. Failure or refusal to make a recommendation is considered a negative
62.29recommendation. The chairs and ranking minority members of the senate Finance
62.30Committee and Capital Investment Committees and the house of representatives Capital
62.31Investment and Ways and Means Committees must also be notified whenever there is a
62.32substantial change in a construction or major remodeling project, or in its cost.
62.33(b) Capital projects exempt from the requirements of this subdivision include
62.34demolition or decommissioning of state assets, hazardous material projects, utility
62.35infrastructure projects, environmental testing, parking lots, parking structures, park
63.1and ride facilities, bus rapid transit stations, light rail lines, exterior lighting, fencing,
63.2highway rest areas, truck stations, storage facilities not consisting primarily of offices or
63.3heated work areas, roads, bridges, trails, pathways, campgrounds, athletic fields, dams,
63.4floodwater retention systems, water access sites, harbors, sewer separation projects, water
63.5and wastewater facilities, port development projects for which the commissioner of
63.6transportation has entered into an assistance agreement under section 457A.04, ice centers,
63.7a local government project with a construction cost of less than $1,500,000, or any other
63.8capital project with a construction cost of less than $750,000.

63.9    Sec. 5. Minnesota Statutes 2012, section 16B.335, subdivision 2, is amended to read:
63.10    Subd. 2. Other projects. All other capital projects for which a specific appropriation
63.11is made must not proceed until the recipient undertaking the project has notified the chairs
63.12and ranking minority members of the senate Capital Investment and Finance Committee
63.13 Committees and the house of representatives Capital Investment and Ways and Means
63.14Committees that the work is ready to begin. Notice is not required for capital projects
63.15needed to comply with the Americans with Disabilities Act, for asset preservation projects
63.16to which section 16B.307 applies, or for projects funded by an agency's operating budget
63.17or by a capital asset preservation and replacement account under section 16A.632, or a
63.18higher education asset preservation and replacement account under section 135A.046.

63.19    Sec. 6. Minnesota Statutes 2013 Supplement, section 16B.335, subdivision 5, is
63.20amended to read:
63.21    Subd. 5. Information technology. Agency requests for construction and
63.22remodeling funds shall include money for cost-effective information technology
63.23investments that would enable an agency to reduce its need for office space, provide
63.24more of its services electronically, and decentralize its operations. The Office of MN.IT
63.25Services must review and approve the information technology portion of construction
63.26and major remodeling program plans before the plans are submitted to the chairs of the
63.27senate Finance Committee and the house of representatives Ways and Means Committee
63.28for their recommendations and the chair and ranking minority member of the senate
63.29Capital Investment Committee and the chair and ranking minority member of the house of
63.30representatives Capital Investment Committee is are notified as required by subdivision 1.

63.31    Sec. 7. Minnesota Statutes 2012, section 134.45, subdivision 5b, is amended to read:
63.32    Subd. 5b. Qualification; improvement grants. A public library jurisdiction may
63.33apply for a grant in an amount up to $1,000,000 or 50 percent, whichever is less, of the
64.1approved costs of renovating or expanding an existing library building, or to construct
64.2a new library building. Renovation may include remediation of conditions hazardous
64.3to health or safety.

64.4    Sec. 8. Minnesota Statutes 2012, section 135A.034, subdivision 2, is amended to read:
64.5    Subd. 2. Capital projects. The Board of Regents of the University of Minnesota
64.6and the Board of Trustees of the Minnesota State Colleges and Universities are requested
64.7to consider the following criteria in establishing priorities for requests for bond funds
64.8for capital projects:
64.9(1) maintenance and preservation of existing facilities;
64.10(2) completion of projects that have received funding;
64.11(3) updating facilities to meet contemporary needs;
64.12(4) providing geographic distribution of capital projects; and
64.13(5) maximizing the use of nonstate contributions.
64.14The criteria listed in this subdivision are not in priority order.

71.29    Sec. 20. EAST METRO INTEGRATION DISTRICT, PROPERTY
71.30CONVEYANCE.
71.31    Subdivision 1. Harambee. Notwithstanding the appropriations of state general
71.32obligation bond proceeds in Laws 1994, chapter 643, section 14, subdivision 7, to Joint
71.33Powers District No. 6067, East Metro Integration District, to acquire and better the
71.34Harambee community school, in Maplewood, the real and personal property of the
71.35Harambee school may be conveyed to Independent School District No. 623, Roseville,
72.1for operation of a multidistrict integration facility that serves students in any grade from
72.2early education through grade 12.
72.3    Subd. 2. Crosswinds. Notwithstanding the appropriation of state general obligation
72.4bond proceeds in Laws 1998, chapter 404, section 5, subdivision 5; Laws 1999, chapter
72.5240, article 1, section 3; Laws 2000, chapter 492, article 1, section 5, subdivision 2; Laws
72.62001, First Special Session chapter 12, section 2, subdivision 2; and Laws 2005, chapter
72.720, article 1, section 5, subdivision 3, to acquire and better the Crosswinds school facilities
72.8by the Joint Powers District No. 6067, East Metro Integration District, in Woodbury, the
72.9Crosswinds school may be conveyed to the Perpich Center for Arts Education for use as
72.10an east metropolitan area integration magnet school.

72.11    Sec. 21. CONVEYANCE OF SURPLUS STATE LAND; WASHINGTON
72.12COUNTY.
72.13(a) Notwithstanding Minnesota Statutes, sections 16A.695 and 16B.281 to 16B.296,
72.14the commissioner of administration may convey to the city of Bayport for no consideration
72.15the surplus land that is described in paragraph (c).
72.16(b) The conveyance must be in a form approved by the attorney general and provide
72.17that the lands revert to the state if the city of Bayport stops using the land for the public
72.18purpose described in paragraph (d). The attorney general may make changes to the land
72.19description to correct errors and ensure accuracy.
72.20(c) The land to be conveyed is located in Washington County and is described as:
72.21That part of the Southeast Quarter of the Southwest Quarter, Section 3, Township 29

73.4    Sec. 22. AMERICAN-MADE STEEL.
73.5To the extent practicable, a public entity receiving an appropriation of public money
73.6for a project in this act must ensure those facilities are built with American-made steel.

73.7    Sec. 23. EFFECTIVE DATE.
73.8    Except as otherwise provided, this article is effective the day following final
73.9enactment.
