HOUSE BILL No. 4457

Rogers, Rendon, Denby, Franz, Genetski, Poleski, MacGregor, Outman, Goike, VerHeulen, MacMaster, Jacobsen, Johnson, Lori, Crawford, Glardon, Pscholka, Victory, Pettalia, Haveman, McBroom, Daley, Bumstead, Graves and Jenkins and referred to the Committee on Judiciary.

 

     A bill to provide that any federal law that attempts to ban

 

certain firearms or magazines is unenforceable in this state; to

 

provide for the powers and duties of certain state officers; to

 

prohibit the enforcement of certain federal laws; and to prescribe

 

penalties.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the

 

"Michigan firearm protection act".

 

     Sec. 2. (1) A public servant or dealer that sells a firearm in

 

this state shall not enforce or attempt to enforce any act, law,

 

statute, rule, or regulation of the United States government

 

relating to a personal firearm, firearm accessory, or ammunition

 

that is owned or manufactured exclusively within the borders of

 

this state.

 

     (2) Any official, agent, or employee of the United States


 

government who enforces or attempts to enforce any act, order, law,

 

statute, rule, or regulation of the United States government upon a

 

personal firearm, a firearm accessory, or ammunition that is owned

 

or manufactured commercially or privately in this state and that

 

remains exclusively within the borders of this state is guilty of a

 

felony punishable by imprisonment for not less than 1 year and 1

 

day or more than 5 years or a fine of not more than $5,000.00.

 

     (3) The attorney general may defend a citizen of this state

 

who is prosecuted by the United States government for a violation

 

of a federal law relating to the manufacture, sale, transfer, or

 

possession of a firearm, a firearm accessory, or ammunition owned

 

or manufactured and retained exclusively within the borders of this

 

state.

 

     (4) Any federal law, rule, regulation, or order created or

 

effective on or after January 1, 2013 is unenforceable within the

 

borders of this state if the law, rule, regulation, or order

 

attempts to do either of the following:

 

     (a) Ban or restrict ownership of a semi-automatic firearm or

 

any magazine of a firearm.

 

     (b) Require any firearm, magazine, or other firearm accessory

 

to be registered in any manner.
