A bill to amend 1927 PA 372, entitled

"An act to regulate and license the selling, purchasing, possessing, and carrying of certain firearms, gas ejecting devices, and electro-muscular disruption devices; to prohibit the buying, selling, or carrying of certain firearms, gas ejecting devices, and electro-muscular disruption devices without a license or other authorization; to provide for the forfeiture of firearms and electro-muscular disruption devices under certain circumstances; to provide for penalties and remedies; to provide immunity from civil liability under certain circumstances; to prescribe the powers and duties of certain state and local agencies; to prohibit certain conduct against individuals who apply for or receive a license to carry a concealed pistol; to make appropriations; to prescribe certain conditions for the appropriations; and to repeal all acts and parts of acts inconsistent with this act,"

(MCL 28.421 to 28.435) by adding section 2c.

the people of the state of michigan enact:

Sec. 2c. (1) Except as otherwise provided in subsection (2), an individual shall not openly carry a rifle or shotgun in this state.

(2) Subsection (1) does not apply to any of the following:

(a) An individual engaged in target practice at a recognized target range.

(b) A peace officer carrying a firearm during the performance of the peace officer's duties.

(c) An individual who is on property owned by that individual.

(d) A member of the United States Armed Forces while carrying the firearm in the line of duty.

(e) An individual who is hunting.

(f) An individual carrying a firearm on the premises of either of the following:

(i) A gun show.

(ii) A federally licensed firearms dealer.

(3) An individual who violates this section is guilty of the following:

(a) For a first offense, a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $1,000.00, or both.

(b) For a second or subsequent offense, a felony punishable by imprisonment of not more than 5 years.

(4) As used in this section:

(a) "Federally licensed firearms dealer" means that term as defined in section 15.

(b) "Gun show" means a building, structure, or facility where dealers and owners of firearms gather to buy, sell, or trade firearms.

(c) "Rifle" means that term as defined in section 222 of the Michigan penal code, 1931 PA 328, MCL 750.222.

(d) "Shotgun" means that term as defined in section 222 of the Michigan penal code, 1931 PA 328, MCL 750.222.
