  1  1    Section 1.  Section 321G.13, subsection 2, paragraph b, Code
  1  2 2017, is amended to read as follows:
  1  3    b.  (1)  A person may operate or ride on a snowmobile with a
  1  4 loaded firearm, whether concealed or not, without a permit to
  1  5 carry weapons, if the person operates or rides on land owned,
  1  6  or possessed, or rented by the person, and the person's conduct
  1  7 is otherwise lawful.
  1  8    (2)  If a person is operating or riding on a snowmobile on
  1  9 land that is not owned, or possessed, or rented by the person,
  1 10 the person may operate or ride the snowmobile with a loaded
  1 11 firearm, whether concealed or not, if all of the following
  1 12 apply:
  1 13    (a)  The firearm is a pistol or revolver and is secured in a
  1 14 retention holster upon the person.
  1 15    (b)  The person has in the person's possession and displays
  1 16 to a peace officer on demand a valid permit to carry weapons
  1 17 which has been issued to the person.
  1 18    (c)  The person's conduct is within the limits of the permit
  1 19 to carry weapons.
  1 20    Sec. 2.  Section 321G.13, Code 2017, is amended by adding the
  1 21 following new subsection:
  1 22    NEW SUBSECTION.  4.  As used in this section, "rented by the
  1 23 person" includes a person who does not necessarily rent the
  1 24 land but who principally provides labor for the production of
  1 25 crops located on agricultural land or for the production of
  1 26 livestock principally located on agricultural land. The person
  1 27 must personally provide such labor on a regular, continuous,
  1 28 and substantial basis.
  1 29    Sec. 3.  Section 321I.14, subsection 2, paragraph b, Code
  1 30 2017, is amended to read as follows:
  1 31    b.  (1)  A person may operate or ride on an all=terrain
  1 32 vehicle with a loaded firearm, whether concealed or not,
  1 33 without a permit to carry weapons, if the person operates or
  1 34 rides on land owned, or possessed, or rented by the person, and
  1 35 the person's conduct is otherwise lawful.
  2  1    (2)  If a person is operating or riding on an all=terrain
  2  2 vehicle on land that is not owned, or possessed, or rented by
  2  3 the person, the person may operate or ride the all=terrain
  2  4 vehicle with a loaded firearm, whether concealed or not, if all
  2  5 of the following apply:
  2  6    (a)  The firearm is a pistol or revolver and is secured in a
  2  7 retention holster upon the person.
  2  8    (b)  The person has in the person's possession and displays
  2  9 to a peace officer on demand a valid permit to carry weapons
  2 10 which has been issued to the person.
  2 11    (c)  The person's conduct is within the limits of the permit
  2 12 to carry weapons.
  2 13    Sec. 4.  Section 321I.14, Code 2017, is amended by adding the
  2 14 following new subsection:
  2 15    NEW SUBSECTION.  6.  As used in this section "rented by the
  2 16 person" includes a person who does not necessarily rent the
  2 17 land but who principally provides labor for the production of
  2 18 crops located on agricultural land or for the production of
  2 19 livestock principally located on agricultural land. The person

  2 22                           EXPLANATION
  2 23 The inclusion of this explanation does not constitute agreement with
  2 24 the explanation's substance by the members of the general assembly.
  2 25    This bill relates to operating or riding a snowmobile or
  2 26 all=terrain vehicle while carrying a firearm.
  2 27    Currently, a person may operate or ride on a snowmobile or
  2 28 all=terrain vehicle with a loaded firearm, whether concealed or
  2 29 not, without a permit to carry weapons, if the person operates
  2 30 or rides on land owned by the person, and the person's conduct
  2 31 is otherwise lawful.
  2 32    The bill allows a person to operate or ride on a snowmobile
  2 33 or all=terrain vehicle with a loaded firearm, whether concealed
  2 34 or not, without a permit to carry weapons, if the person
  2 35 operates or rides on the snowmobile or all=terrain vehicle
  3  1 on land rented by the person, and the person's conduct is
  3  2 otherwise lawful.  The bill specifies that "rented by the
  3  3 person" includes a person who does not necessarily rent the
  3  4 land but who principally provides labor for the production of
  3  5 crops located on agricultural land or for the production of
  3  6 livestock principally located on agricultural land. The person
  3  7 must personally provide such labor on a regular, continuous,
  3  8 and substantial basis.
  3  9    A person who violates Code section 321G.13 (snowmobiles) or
  3 10 321I.14 (all=terrain vehicles) commits a simple misdemeanor
  3 11 punishable as a scheduled fine of $100 under Code section
  3 12 805.8B.
