                                 SENATE JOINT RESOLUTION

                                      SENATE JOINT RESOLUTION

  1 A Joint Resolution expressing the Iowa General Assembly's
  2    refusal to recognize or support any statutes, presidential
  3    directives, or other regulations and proclamations which
  4    conflict with the Second Amendment of the Constitution of
  5    the United States and which are expressly preempted by the
  6    rulings of the United States Supreme Court.
  7 WHEREAS, the Second Amendment to the Constitution of the
  8 United States provides that "A well regulated militia, being
  9 necessary to the security of a free state, the right of the
 10 people to keep and bear arms, shall not be infringed"; and
 11 WHEREAS, the Second Amendment protects the rights of
 12 self=defense, defense of others, and defense of the nation; and
 13 WHEREAS, it is estimated that more than 70 million people,
 14 representing more than half of the households in America, have
 15 chosen to lawfully exercise the right to bear arms and defend
 16 themselves and their families; and
 17 WHEREAS, the vast majority of all lawfully owned firearms in
 18 America are not used in crime; and
 19 WHEREAS, the United States Supreme Court in District of
 20 Columbia v. Heller, 554 U.S. 570 (2008), ruled that the Second
 21 Amendment protects an individual's right to keep and bear
 22 arms; and
 23 WHEREAS, the United States Supreme Court in McDonald v.
 24 City of Chicago, 561 U.S. 3025 (2010), ruled that the right of
 25 an individual to keep and bear arms protected by the Second
 26 Amendment is incorporated by the Due Process Clause of the
 27 Fourteenth Amendment to the Constitution of the United States
 28 and applies to the states; and
 29 WHEREAS, studies by the National Academies of Science
 30 and the Centers for Disease Control have found no persuasive
 31 evidence that "gun control" laws actually reduce crime; NOW
 32 THEREFORE,
 33 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    That the General Assembly of the State of Iowa will uphold
  1  2 the Second Amendment to the Constitution of the United States
  1  3 and will act in conformity with its members' sworn duties as
  1  4 duly elected officials charged with the public trust; and
  1  5    BE IT FURTHER RESOLVED, That the General Assembly of
  1  6 the State of Iowa will not act to enforce any statutes,
  1  7 presidential directives, or other regulations and proclamations
  1  8 which conflict with the Second Amendment to the Constitution
  1  9 of the United States and that are expressly preempted by the
  1 10 rulings of the United States Supreme Court; and
  1 11    BE IT FURTHER RESOLVED, That the Secretary of the Senate
  1 12 shall transmit certified copies of this Joint Resolution to
  1 13 the President of the United States, the Speaker of the United
  1 14 States House of Representatives, the President of the United
  1 15 States Senate, the Majority and Minority Leaders of the United
  1 16 States Senate and the United States House of Representatives,
  1 17 and to each member of Iowa's congressional delegation.

  1 19 The inclusion of this explanation does not constitute agreement with
  1 20 the explanation's substance by the members of the general assembly.
  1 21    This joint resolution expresses the Iowa General Assembly's
  1 22 refusal to recognize or support any statutes, presidential
  1 23 directives, or other regulations and proclamations which
  1 24 conflict with the Second Amendment to the Constitution of the
  1 25 United States and which are expressly preempted by the rulings
  1 26 of the United States Supreme Court.
