  1  1    Section 1.  Section 724.1, subsection 1, paragraph h, Code
  1  2 2015, is amended by striking the paragraph.
  1  3                           EXPLANATION
  1  4 The inclusion of this explanation does not constitute agreement with
  1  5 the explanation's substance by the members of the general assembly.
  1  6    Current law provides that a mechanical device specifically
  1  7 constructed and designed so that when attached to a firearm it
  1  8 silences, muffles, or suppresses the sound when fired is an
  1  9 offensive weapon.  Under Code section 724.3, any person who
  1 10 knowingly possesses an offensive weapon commits a class "D"
  1 11 felony, punishable by confinement for no more than five years
  1 12 and a fine of at least $750 but not more than $7,500.
  1 13    The bill strikes the provision in Code section 724.1(1)(h)
  1 14 that classifies a firearm suppressor as an offensive weapon.
  1 15 By striking this provision, a firearm suppressor is legal to
  1 16 possess in the state subject to federal regulations.
