SYNOPSIS AS INTRODUCED:
55 ILCS 5/5-1133.1 new

Amends the Counties Code. Provides that county contracts may be awarded as a sole source procurement unless an interested party submits a written request for a public hearing. Provides that contracts for professional or artistic services cannot be amended through use of sole source procurements if the result would increase in the amount paid under the contract of more than 5% of the initial award, or would extend the contract term beyond the time reasonably needed for a competitive procurement, not to exceed 2 months. Further provides for notice requirements and requires the county board to file a yearly report with the General Assembly concerning procurement contracts entered into. Effective immediately.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Counties Code is amended by adding Section
55-1133.1 as follows:
6 (55 ILCS 5/5-1133.1 new)
7 Sec. 5-1133.1. Sole source procurements.
8 (a) In accordance with standards set by ordinance,
9contracts may be awarded without use of the specified method of
10source selection when there is only one economically feasible
11source for the item. A county contract may be awarded as a sole
12source procurement unless an interested party submits a written
13request for a public hearing at which the purchasing agency
14presents written justification for the procurement method. Any
15interested party may present testimony. A sole source contract
16where a hearing was requested by an interested party may be
17awarded after the hearing is conducted with the approval of the
18county board.
19 (b) This Section may not be used as a basis for amending a
20contract for professional or artistic services if the amendment
21would result in an increase in the amount paid under the
22contract of more than 5% of the initial award, or would extend
23the contract term beyond the time reasonably needed for a

1competitive procurement, not to exceed 2 months.
2 (c) Notice of intent to enter into a sole source contract
3shall be provided to the public and published on the county's
4website at least 14 calendar days before the public hearing
5required in subsection (a). The notice shall include the sole
6source procurement justification form prescribed by the county
7board, a description of the item to be procured, the intended
8sole source contractor, and the date, time, and location of the
9public hearing.
10 (d) By August 1 each year, each county board shall file a
11report with the General Assembly identifying each contract the
12officer sought under the sole source procurement method and
13providing the justification given for seeking sole source as
14the procurement method for each of those contracts.
15 Section 99. Effective date. This Act takes effect upon
16becoming law.
