2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Environmental Protection Act is amended by |
5 | | changing Sections 3.335, 3.465, and 3.535 and by adding Section |
6 | | 3.560 as follows:
|
7 | | (415 ILCS 5/3.335) (was 415 ILCS 5/3.27)
|
8 | | Sec. 3.335. Pollution control waste. "Pollution control |
9 | | waste"
means any liquid, solid, semi-solid or gaseous waste |
10 | | generated as a direct
or indirect result of the removal of |
11 | | contaminants from the air,
water or land, and which pose a |
12 | | present or potential threat
to human health or to the |
13 | | environment or with inherent
properties which make the disposal |
14 | | of such waste in a landfill
difficult to manage by normal |
15 | | means. "Pollution control waste"
includes but is not limited to |
16 | | water and wastewater treatment
plant sludges, baghouse dusts, |
17 | | landfill waste, scrubber sludges
and chemical spill cleanings. |
18 | | "Pollution control waste" does not include exceptional quality |
19 | | biosolids.

treatment plant, water supply treatment |
3 | | plant, or air pollution control
facility or any other such |
4 | | waste having similar characteristics and effects. "Sludge" |
5 | | does not include exceptional quality biosolids.

8 | | Sec. 3.535. Waste.
"Waste" means any garbage, sludge from |
9 | | a waste treatment plant,
water supply treatment plant, or air |
10 | | pollution control facility or other
discarded material, |
11 | | including solid, liquid, semi-solid, or contained
gaseous |
12 | | material resulting from industrial, commercial, mining and
|
13 | | agricultural operations, and from community activities, but |
14 | | does not
include solid or dissolved material in domestic |
15 | | sewage, exceptional quality biosolids, or solid or
dissolved |
16 | | materials in irrigation return flows, or coal combustion
|
17 | | by-products as defined in Section 3.135, or industrial
|
18 | | discharges which are point sources subject to permits under |
19 | | Section
402 of the Federal Water Pollution Control Act, as now |
20 | | or hereafter
amended, or source, special nuclear, or by-product |
21 | | materials as
defined by the Atomic Energy Act of 1954, as |
22 | | amended (68 Stat. 921)
or any solid or dissolved material from |
23 | | any facility subject to
the Federal Surface Mining Control and |
24 | | Reclamation Act of 1977 (P.L.
95-87) or the rules and |
25 | | regulations thereunder or any law or rule or
regulation adopted |

4 | | Sec. 3.560. Exceptional quality biosolids. "Exceptional |
5 | | quality biosolids" means solids produced by advanced treatment |
6 | | of wastewater treatment plant sludge through stabilization and |
7 | | other processes to meet the following requirements of 40 C.F.R. |
8 | | Part 503: the pollutant concentrations in Table 3 of Section |
9 | | 503.13(b), the Class A pathogen requirements in Section 503.32, |
10 | | and one of the vector attraction requirements in Section |
11 | | 503.33(b)(1)-(8).
