SYNOPSIS AS INTRODUCED:
430 ILCS 68/5-20

Amends the Firearm Dealer License Certification Act. Provides that packaging of any firearm and any descriptive materials that accompany any firearm sold or transferred by a certified licensee shall bear a label containing a specified warning statement. Contains requirements for the warning statement. Requires certified licensees to post conspicuously within the licensed premises an additional notice regarding suicide.

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Firearm Dealer License Certification Act is
5amended by changing Section 5-20 as follows:
6 (430 ILCS 68/5-20)
7 Sec. 5-20. Additional licensee requirements.
8 (a) A certified licensee shall make a photo copy of a
9buyer's or transferee's valid photo identification card
10whenever a firearm sale transaction takes place. The photo copy
11shall be attached to the documentation detailing the record of
12sale.
13 (b) A certified licensee shall post in a conspicuous
14position on the premises where the licensee conducts business a
15sign that contains the following warning in block letters not
16less than one inch in height:
17 "With few exceptions enumerated in the Firearm Owners
18 Identification Card Act, it is unlawful for you to:
19 (A) store or leave an unsecured firearm in a place
20 where a child can obtain access to it;
21 (B) sell or transfer your firearm to someone else
22 without receiving approval for the transfer from the
23 Department of State Police, or

1 (C) fail to report the loss or theft of your
2 firearm to local law enforcement within 72 hours.".
3This sign shall be created by the Department and made available
4for printing or downloading from the Department's website.
5 (c) No retail location established after the effective date
6of this Act shall be located within 500 feet of any school,
7pre-school, or day care facility in existence at its location
8before the retail location is established as measured from the
9nearest corner of the building holding the retail location to
10the corner of the school, pre-school, or day care facility
11building nearest the retail location at the time the retail
12location seeks licensure.
13 (d) The packaging of any firearm and any descriptive
14materials that accompany any firearm sold or transferred in
15this State, or delivered for sale in this State, by a certified
16licensee shall bear a label containing the following warning
17statement:

"WARNING
19
Firearms must be handled responsibly and securely stored to
20
prevent access by children and other unauthorized users.
21
Illinois has strict laws pertaining to firearms, and you may be
22
fined or imprisoned if you fail to comply with them.
23
Prevent child access by always keeping guns locked away and
24
unloaded when not in use. If you keep a loaded firearm where a

child obtains and improperly uses it, you may be fined or sent
2
to jail.

If you or someone you know is contemplating suicide, please
4
call the national suicide prevention lifeline at
5
1-800-273-TALK (8255)."
6 A yellow triangle containing an exclamation mark shall
7appear immediately before the word "Warning" on the label.
8 If the firearm is sold or transferred without accompanying
9packaging, the warning label or notice shall be affixed to the
10firearm itself by a method to be prescribed by the Illinois
11State Police.
12 The warning statement required under this subsection shall
13satisfy both of the following requirements:
14 (1) It shall be displayed in its entirety on the
15 principal display panel of the firearm's package, and on
16 any descriptive materials that accompany the firearm.
17 (2) It shall be displayed in both English and Spanish,
18 in conspicuous and legible type in contrast by typography,
19 layout, or color with other printed matter on that package
20 or descriptive materials, in a manner consistent with 16
21 CFR 1500.121, or successor regulations thereto.
22 (e) A certified licensee shall post conspicuously within
23the licensed premises, in block letters not less than one inch
24in height, an additional notice, including, but not limited to,
25a notice provided by a suicide prevention program, containing

1the following statement:

"IF YOU OR SOMEONE YOU KNOW IS CONTEMPLATING SUICIDE, PLEASE
3
CALL THE NATIONAL SUICIDE PREVENTION LIFELINE AT
4
1-800-273-TALK (8255)."
