SENATE JOINT RESOLUTION
2 WHEREAS, Background checks through the National Instant
3Criminal Background Check System are a prerequisite and
4requirement of acquiring and possessing firearms and
5ammunition; and
6 WHEREAS, Background checks are meant to ensure that people
7who are legally prohibited from owning, acquiring, or
8possessing firearms, such as criminals, mentally unstable
9individuals, or other persons enumerated in Section 8 of the
10Firearm Owners Identification Card Act are unable to do so; and
11 WHEREAS, Firearm Owners Identification Card background
12check information and the National Instant Criminal Background
13Check System are only as good as the information submitted by
14the courts and law enforcement; and
15 WHEREAS, The Firearm Owners Identification Card Act
16requires the courts and the Department of State Police to fully
17comply with the requirements for reporting data submitted to
18the National Instant Criminal Background Check System; and
19 WHEREAS, It is the duty of the Department of State Police
20to revoke and seize a Firearm Owners Identification Card from a
21person prohibited from possessing firearms or ammunition, as

1well as to ensure that such persons no longer possess any
2firearms or ammunition; therefore, be it
3 RESOLVED, BY THE SENATE OF THE ONE HUNDRED FIRST GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that the Auditor General shall conduct a
6performance audit of the Department of State Police's
7administration of the Firearm Owners Identification Card Act;
8and be it further
9 RESOLVED, That the Auditor General shall review, among
10other things, information reported to the Department of State
11Police by clerks of the circuit court and municipal courts
12under the Firearm Owners Identification Card Act, the database
13utilized by the Department of State Police in reporting
14information to the National Instant Criminal Background Check
15System, the method of reporting any revocations to the National
16Instant Criminal Background Check System, and the method of
17ensuring that a person who had a Firearm Owners Identification
18Card revoked is no longer in possession of a firearm or
19ammunition; and be it further
20 RESOLVED, That the Department of State Police and any other
21State agency, entity, or person that may have information
22relevant to this audit cooperate fully and promptly with the
23Auditor General's office in its conduct; and be it further

1 RESOLVED, That the Auditor General commence this audit as
2soon as possible and, upon completion, distribute a report in
3accordance with Section 3-14 of the Illinois State Auditing
4Act.
