HOUSE CONCURRENT
RESOLUTION
REQUESTING THE AUDITOR TO CONDUCT A SUNRISE ANALYSIS OF THE PROPOSED REGULATION OF TRANSPORTATION NETWORK COMPANIES.
WHEREAS, a transportation network company is an entity that uses a digital network or software application service to connect passengers to transportation network company drivers, but neither owns, controls, operates, or manages the vehicles used by transportation network company drivers nor purports to be either a taxicab association or a for-hire vehicle owner; and
WHEREAS, neither a transportation network company nor a transportation network company driver appears to be regulated under laws that regulate common carriers by motor vehicle, contract carriers by motor vehicle, motor carriers, or for-hire vehicle services; and
WHEREAS, it appears that transportation network companies and transportation network company drivers currently operate without a license or permit from the State to provide transportation network company services to the public; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2015, the Senate concurring, that the Auditor is requested to conduct a sunrise analysis of the regulation of transportation network companies as proposed in S.B. No. 1280, S.D. 2, H.D. 1 (Regular Session of 2015); and
BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations, including any proposed legislation, to the Legislature not later than twenty days prior to the convening of the Regular Session of 2016; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Chairperson of the Public Utilities Commission.
