       Senator Simmons moved the following:
       
    1         Senate Amendment to Amendment (234288) (with title
    2  amendment)

    4         Delete lines 368 - 378
    5  and insert:
    6         (13)(a) A person younger than 25 years of age may not
    7  purchase an assault weapon. The sale or transfer of an assault
    8  weapon to a person younger than 25 years of age may not be made
    9  or facilitated by any person, including a licensed importer,
   10  licensed manufacturer, or licensed dealer. A person who violates
   11  this subsection commits a felony of the third degree, punishable
   12  as provided in s. 775.082, s. 775.083, or s. 775.084. As used in
   13  this paragraph, the term “assault weapon” means a fully
   14  automatic or semiautomatic rifle or shotgun or a semiautomatic
   15  rifle or shotgun that has a fixed magazine capacity of more than
   16  10 rounds of centerfire ammunition. The term also includes a
   17  semiautomatic rifle or shotgun when it is loaded with a
   18  detachable magazine having a capacity of more than 10 rounds of
   19  centerfire ammunition or when the rifle or shotgun is possessed
   20  by a person who also possesses a detachable magazine for the
   21  rifle or shotgun which has a capacity of more than 10 rounds of
   22  centerfire ammunition.
   23         (b) The prohibitions in paragraph (a) do not apply to the
   24  purchase of a rifle or shotgun by a law enforcement officer or
   25  correctional officer, as those terms are defined in s.
   26  943.10(1), (2), (3), (6), (7), (8), or (9), to a servicemember
   27  as defined in s. 250.01, to a person 21 years of age or older
   28  who successfully completes a minimum of a 16-hour hunter safety
   29  course and possesses a hunter safety certification card issued
   30  under s. 379.3581, or to a person licensed to carry a concealed
   31  weapon or firearm pursuant to s. 790.06. This paragraph expires
   32  on July 1, 2023, unless renewed by the Legislature.
