AN ACT PROHIBITING ZONING COMMISSIONS FROM REQUIRING SPECIAL PERMITS OR SPECIAL EXCEPTIONS FOR USES MADE NONCONFORMING BY NEW ZONING REGULATIONS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That section 8-2 of the general statutes be amended to prohibit zoning commissions from requiring a special permit or special exception for the continuance of a use, building or structure made nonconforming upon adoption of new zoning regulations.
Statement of Purpose:
To resolve a conflict between appellate court rulings and prevent the inadvertent extinguishment of property rights.
