An act relating to firearms. to add Section 39837.2 to the Education Code, relating to schoolbuses.

AB 1453, as amended, Eduardo Garcia. Crimes: unlawful discharge of firearms. Schoolbuses: volunteer transportation.
Existing law provides for the provision of transportation services by school districts, including by schoolbus, as defined, and requires the State Board of Education to adopt reasonable regulations relating to the use of schoolbuses by school districts and others. Existing law requires the Department of the California Highway Patrol to adopt regulations regarding the safe operation of school buses, as prescribed.
Under existing law, the governing board of a school district is authorized to use and operate any bus owned or under lease to the district to transport pupils to and from their places of employment during the summer in connection with a summer employment program for youth, and required to adequately insure against the liability of the district, members of the board, and officers and employees of the district in connection with furnishing the transportation. Existing law also authorizes the governing board of a school district to use schoolbuses to transport persons other than pupils for purposes of specified community recreation activities, and to transport district employees and parents of pupils to and from educational activities authorized by the district.
This bill would authorize the governing board of a school district to use and operate any bus owned or under lease to the school district for the transportation of adult volunteers to and from a school within the school district for the purpose of participating in volunteer activities with pupils at the school, and would require the school district to provide adequate liability insurance, as specified.

Existing law prohibits shooting at an inhabited house, housecar, or camper, or an occupied building, vehicle, or aircraft. Existing law also prohibits shooting at an uninhabited house or unoccupied building, vehicle, or aircraft. Existing law additionally prohibits the discharge of a firearm in a grossly negligent manner.

This bill would express the intent of the Legislature to enact legislation prohibiting the discharge of a firearm into the air on New Year’s Eve.

The people of the State of California do enact as follows:


SECTION 1.

 Section 39837.2 is added to the Education Code, to read:

39837.2.
 The governing board of a school district may use and operate any bus owned or under lease to the school district for the transportation of adult volunteers to and from a school within the school district for the purpose of participating in volunteer activities with pupils at the school. The governing board of a school district shall, in accordance with Section 35208, adequately insure against the liability of the school district, members of the governing board of the school district, and officers and employees of the school district in connection with furnishing the transportation.

SECTION 1.

It is the intent of the Legislature to enact legislation prohibiting the discharge of a firearm into the air on New Year’s Eve.
