AN ACT
Amending section 11-424.01, Arizona Revised Statutes; relating to county officers.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 11-424.01, Arizona Revised Statutes, is amended to read:
11-424.01. Salaries of precinct officers other than justices of the peace; definition
A. At the regular June meeting of the several boards of supervisors preceding a general election, the boards shall fix the salaries of all precinct officers, other than justices of the peace, for those officers to be elected for the four‑year period commencing on the first day of the following January.
B. In precincts with an average of one hundred or fewer total documents served per year by a constable over the previous four years, a constable is entitled to receive an annual salary of not more than fifteen sixteen thousand five hundred dollars.
C. In precincts with an average of more than one hundred total documents served per year by a constable over the previous four years, the constables shall be paid as follows:
1. In precincts with five thousand or fewer registered voters, the constables shall receive annual salaries of not more than fifteen sixteen thousand five hundred dollars.
2. In precincts with more than five thousand registered voters but fewer than ten thousand registered voters, annual salaries of not more than twenty-three twenty-six thousand five hundred dollars.
3. In precincts with ten thousand or more registered voters but fewer than twelve thousand registered voters, annual salaries of not less than twenty-nine thousand four hundred thirty-seven nor more than thirty-six forty thousand one hundred dollars.
4. In precincts with twelve thousand or more registered voters but fewer than sixteen thousand registered voters, annual salaries of not less than thirty‑six thousand one hundred nor more than forty‑five fifty thousand eight hundred twenty‑five dollars.
5. In precincts with sixteen thousand or more registered voters, annual salaries of not less than forty‑eight thousand two hundred ninety‑four nor more than sixty‑one sixty-seven thousand two hundred eight dollars.
D. The board of supervisors shall determine, subject to subsections B and C of this section, the salary of a constable appointed to fill a vacancy caused otherwise than by expiration of the term. Nothing in this subsection shall be deemed to authorize an increase or decrease in the salary during the term of office of a constable appointed to fill a vacancy.
E. For the purposes of this section, "registered voter" means a qualified elector of a precinct who is registered on June 1 of each year.
Sec. 2. Constable study committee; membership; duties; report; delayed repeal
A. The constable study committee is established consisting of the following members:
1. One member of the house of representatives who is appointed by the speaker of the house of representatives and who serves as cochairperson of the committee.
2. One member of the senate who is appointed by the president of the senate and who serves as cochairperson of the committee.
3. Two public members, one of whom is from a county with a population of one million persons or more and who is appointed by the speaker of the house of representatives and one of whom is from a county with a population of less than one million persons and who is appointed by the president of the senate.
4. Two constables, one of whom is from a county with a population of one million persons or more and who is appointed by the president of the senate and one of whom is from a county with a population of less than one million persons and who is appointed by the speaker of the house of representatives.
5. Two justices of the peace, one of whom is from a county with a population of one million persons or more and one of whom is from a county with a population of less than one million persons and both of whom are appointed by the presiding justice of the peace of a county with a population of more than one million persons.
B. The study committee shall research and report on the following:
1. Constable duties.
2. Constable salaries.
3. Calculating constable salaries on workload instead of population.
4. Current statutes that regulate constables.
C. The constable study committee may:
1. Request information, data and reports from any constable, county, state agency or political subdivision of this state. If possible, information must be provided electronically. If requested, a constable, county, state agency or political subdivision of this state shall provide the information, data and reports.
2. Hold hearings, conduct fact-finding tours and take testimony from witnesses who may assist the committee in fulfilling its responsibilities.
D. On request of the constable study committee, an agency of this state shall provide to the committee its services, equipment, documents, personnel and facilities to the extent possible without cost to the committee.
E. The legislature shall provide staff and support services to the committee.
F. The committee shall meet at the state capitol or at other places as the cochairpersons deem necessary or convenient, and all meetings must be open to the public.
G. Members of the study committee are not eligible to receive compensation but are eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2, Arizona Revised Statutes.
H. On or before January 15, 2015, the study committee shall submit a report regarding its findings and recommendations to the governor, the speaker of the house of representatives and the president of the senate and provide a copy of its report to the secretary of state.
I. This section is repealed from and after June 30, 2015.
