AN ACT
amending title 13, chapter 36, Arizona Revised Statutes, by adding section 13‑3626; relating to family offenses.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 13, chapter 36, Arizona Revised Statutes, is amended by adding section 13-3626, to read:
13-3626. Unattended child in motor vehicle; classification
A. It is unlawful for a person who is responsible for a child who is under ten years of age to intentionally, knowingly or recklessly leave the child in a motor vehicle without supervision in the motor vehicle by another person who is at least fourteen years of age if either of the following applies:
1. The conditions present a risk to the child's health or safety.
2. The motor vehicle engine is running or the key to the motor vehicle is located in the passenger compartment.
B. A person who violates this section is guilty of a class 3 misdemeanor, except that a second or subsequent violation is a class 2 misdemeanor.
