    An act to amend Section 20001 of the Government Code,
relating to public employees' retirement.   An act to
amend Section 16150 of the Penal Code, relating to ammunition. 


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1235, as amended, De León.  Public employees'
retirement.   Ammunition.  
   Existing law defines the term "ammunition" for certain prohibited
ammunition transactions to mean ammunition principally for use in
handguns, as specified. Existing law makes the violation of those
prohibited transactions a crime.  
   This bill would instead define the term "ammunition" for those and
other purposes to mean one or more loaded cartridges consisting of a
primer case, propellant, and with one or more projectiles. 

   By expanding the scope of an existing crime, this bill would
impose a state-mandated local program.  
   The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.  
   This bill would provide that no reimbursement is required by this
act for a specified reason.  
   The Public Employees' Retirement Law specifies that its purpose is
to provide a means for public employees who become superannuated or
otherwise incapacitated to be replaced by more capable employees and,
to that end, provide a retirement system consisting of retirement
compensation and death benefits.  
   This bill would make a nonsubstantive change to those provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 16150 of the   Penal
Code   is amended to read: 
   16150.  (a) As used in  Section 30300,   this
part, except as specified in subdivision (b),  "ammunition"
means  handgun ammunition as defined in Section 16650.
  one or more loaded cartridges consisting of a primer
case, propellant, and with one or more projectiles. "Ammunition" does
not include blanks. 
   (b) As used in subdivision (a) of Section 30305 and in Section
30306, "ammunition" includes, but is not limited to, any bullet,
cartridge, magazine, clip, speed loader, autoloader, or projectile
capable of being fired from a firearm with a deadly consequence.
"Ammunition" does not include blanks.
   SEC. 2.    No reimbursement is required by this act
pursuant to Section 6 of Article XIII B of the California
Constitution because the only costs that may be incurred by a local
agency or school district will be incurred because this act creates a
new crime or infraction, eliminates a crime or infraction, or
changes the penalty for a crime or infraction, within the meaning of
Section 17556 of the Government Code, or changes the definition of a
crime within the meaning of Section 6 of Article XIII B of the
California Constitution.  
  SECTION 1.    Section 20001 of the Government Code
is amended to read:
   20001.  The purpose of this part is to effect economy and
efficiency in the public service by providing a means by which
employees who become superannuated or otherwise incapacitated may,
without hardship or prejudice, be replaced by more capable employees,
and to that end provide a retirement system consisting of retirement
compensation and death benefits.
